EC East MDs Nos. 1-5, EC East Commercial MD, EC East Industrial - HB25-1219 Notice
EC East Metropolitan District No. 1, EC East Metropolitan District No. 2, EC East Metropolitan District No. 3, EC East Metropolitan District No. 4, EC East Metropolitan District No. 5, EC East Industrial Metropolitan District, and EC East Commercial Metropolitan District (“Districts”) are Title 32 Special Districts that have been established for the purpose of financing and installing street, park and recreation, water, storm drainage, sanitation, and traffic and safety protection, and the provision of covenant enforcement, design review, and security services; and all other improvements or services permitted by Article 1, Title 32, C.R.S. (collectively, the “Public Improvements and Services”), except as specifically limited by the Districts’ respective Service Plan for the Districts approved by the Board of County Commissioners of Elbert County, Colorado on November 13, 2024, as they may be amended from time to time (the “Service Plans”).
The Public Improvements and Services are for the use and benefit of the residents and taxpayers of the Districts. The Districts are located in Elbert County, Colorado. The Districts are quasi-municipal political subdivisions of the State of Colorado authorized to provide specialized services that Elbert County does not provide.
The Districts may incur, in the aggregate, a maximum debt of $185,535,000. Ad valorem property taxes, income derived from the reinvestment of construction funds, capitalized interest, annual tax receipts, and specific ownership taxes may be used to repay such debt. In addition, the Districts may also use fees, rates, tolls, charges, or penalties to repay such debt.
The Districts may each assess, as adjusted for statutory or legislative changes as of January 1, 2019, a maximum mill levy of 55.664 to repay such debt. Once a debt mill levy is imposed, it can only be imposed for forty (40) years.
The Districts must file an Annual Report to the Elbert County Board of County Commissioners, Elbert County Clerk and Recorder, the Division of Local Government, and the State Auditor.
The Districts’ boundaries overlap with the boundaries of: Elbert County, Kiowa C-2 School District, Kiowa Fire Protection District, Elbert County Library District, and Kiowa Soil Conservation District.
