As required by Section 32-1-207(3)(c), C.R.S. and Section VI of the Service Plan of EC East Metropolitan District No. 3 (the “District”), approved by the Board of County Commissioners of Elbert County (the “County”) on November 13, 2024, the following report of the activities of the District from January 1, 2025 to December 31, 2025 (the “Report Year”) is hereby submitted.
A. Boundary changes made: The District did not change its boundaries during the Report Year.
B. Intergovernmental Agreements entered into or terminated: The District entered into the following Intergovernmental Agreement during the Report Year:
i. Memorandum of Understanding by and between the District, EC East Metropolitan District Nos. 1, 2, 4 and 5, EC East Industrial Metropolitan District, EC East Commercial Metropolitan District, dated July 24, 2025.
C. Access information to obtain a copy of rules and regulations adopted: The District did not adopt any rules or regulations as of December 31, 2025. In the event the District adopts rules or regulations in the future, such documents may be accessed at the offices of McGeady Becher Cortese Williams P.C., 450 E. 17th Avenue, Suite 400, Denver, CO 80203, (303) 592-4380.
D. Summary of litigation involving the District’s public improvements: To the best of our knowledge, there was no litigation involving any of the Public Improvements of the District during the Report Year.
E. Status of the District’s construction of public improvements: To the best of our knowledge, the District did not construct any public improvements during the Report Year.
F. Conveyances or dedications of facilities or improvements, constructed by the District, to the County: There were no facilities or improvements constructed by the District that were dedicated to or accepted by the City during the Report Year.
G. Final assessed valuation of the District for the Report Year: $10
H. Current year’s budget: The District was in inactive status pursuant to Section 32-1-104, C.R.S. and was not required to file a budget.
I. Audited financial statements for the Report Year (or application for exemption from audit): The District is currently exempt from audit, pursuant to Section 29-1-604, C.R.S. A copy of the 2025 Application for Exemption from Audit is linked below.

Notice of any uncured events of default by the District, which continue beyond a ninety (90) day period, under any debt instrument: To our knowledge, there are no uncured events of default by the District which continue beyond a ninety (90) day period.
K. Any inability of the District to pay its obligations as they come due, in accordance with the terms of such obligations, which continues beyond a ninety (90) day period: To our knowledge, the District has been able to pay its obligations as they come due.
